PEVVELA Terms of Use
Version: 1.0 Last updated: August 24, 2026 Effective date: 24 August 2026
These Terms of Use (“Terms”) govern your use of the PEVVELA app (“PEVVELA”, “App”, “we”, “us”), provided by Sergei Kokota.
By installing, opening, or using PEVVELA, you confirm that you have read these Terms and agree to be bound by them. If you do not agree, do not use the App.
Use of the app obtained through the Apple App Store is also governed by applicable Apple terms, including Apple’s Standard EULA for licensed applications, unless a separate custom EULA is published for the app.
1. What PEVVELA is
PEVVELA is an app for local music playback and synchronized listening on nearby compatible devices.
Depending on version, device, region, permissions, and available services, PEVVELA may include:
- Local Library import and organization;
- playlists;
- library import and export;
- local playback;
- Speaker Group synchronized playback across multiple devices;
- control of compatible Apple Music features on your device;
- AirPlay;
- light visual effects;
- diagnostics and support;
- paid PEVVELA Plus features.
Available features may change over time.
2. License to use
Subject to these Terms and applicable Apple terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use PEVVELA on Apple devices you lawfully control, for personal or other lawful purposes.
You do not acquire ownership of PEVVELA, its source code, design, trademarks, or other app elements.
3. Local Library
PEVVELA lets you import compatible audio files into a local in-app library.
You choose files to import and are responsible for having the rights, permissions, or other lawful basis to store, play, copy, export, or transmit them to other devices.
PEVVELA does not grant you rights in third-party music or other materials merely because the app can technically import or play a file.
4. Playlists, import, and export
PEVVELA playlists are logical organization inside the local library. The same physical track may appear in multiple playlists without creating extra working copies inside the app library.
When exporting, PEVVELA may create file copies in exported folder or archive structure so exported content matches selected playlists. You choose the destination through Apple system means such as Files, AirDrop, or another app.
We do not guarantee that a third-party app or service will preserve structure, metadata, or compatibility of exported files unchanged.
5. Speaker Group
Speaker Group lets one device host a synchronized playback session and other compatible devices join. Sessions are established directly between nearby devices over a shared local Wi‑Fi network or a direct device-to-device wireless link. A shared Wi‑Fi router is not required, but the connection does not pass through the internet and does not use a developer-operated relay.
For Speaker Group to work, devices may exchange local-track audio data, metadata, control commands, temporary identifiers, and sync technical information only within such direct participant links.
By joining Speaker Group, you agree to this data exchange between participating devices to the extent required for the feature.
The host is responsible for having the right to play and transmit the selected local audio file to participants in the relevant context. Each participant is responsible for the lawfulness of their own use of received content.
6. Sync and connection quality
PEVVELA is designed for accurate synchronized playback, but results depend on hardware, iOS version, direct link quality (local Wi‑Fi or peer-to-peer), distance between participants, device load, audio route, system interruptions, and other factors outside the developer’s control.
We do not guarantee zero latency, uninterrupted connection, zero sync drift, or identical timing on all equipment and network conditions.
7. Auto-Join and previously connected devices
When Auto-Join is enabled, PEVVELA may use locally stored information about previously successful connections to simplify reconnection.
You are responsible for choosing an appropriate connection mode and should disable Auto-Join if automatic rejoin is undesirable on a particular device or in a particular environment.
8. Apple Music
Some PEVVELA features may interact with Apple Music through official Apple APIs.
Use may require:
- a compatible device and iOS version;
- your permission;
- an available Apple ID;
- an active Apple Music subscription where Apple requires it;
- feature availability in your country or region.
Apple Music is an Apple service. PEVVELA does not control its catalog, pricing, subscriptions, content availability, licensing rules, Apple ID operation, or Apple API changes.
PEVVELA does not provide a separate license to Apple Music content and does not remove restrictions imposed by Apple or rights holders.
9. AirPlay and other system services
When you use AirPlay, Share Sheet, Files, or other system features, data may be sent to a device, app, or service you choose. Such features are provided by Apple or the relevant third party and may be governed by their own terms.
10. PEVVELA Plus
Some features may be available only through a paid PEVVELA Plus subscription.
Before purchase, you should see the current subscription name, period, price, and included features. Price, currency, taxes, and availability are determined by the App Store and may vary by country or region.
If purchase-screen information differs from this document, the App Store information shown at confirmation applies.
11. Auto-renewing subscription
If PEVVELA Plus is offered as an auto-renewable subscription, it renews automatically under the terms shown by Apple at purchase unless you cancel through Apple ID/App Store settings within Apple’s allowed window before the next renewal.
Payment is charged by Apple to the payment method linked to your Apple ID. Subscription management and cancellation are handled through Apple.
Deleting the app from your device does not by itself cancel an active subscription.
12. Restore Purchases
PEVVELA may offer Restore Purchases to restore entitlement to previously purchased features according to StoreKit data and Apple rules.
Restore success depends on Apple ID, App Store, product, and applicable Apple policies.
13. Refunds
App Store payments are processed by Apple. Refund requests are handled by Apple under its policies and applicable law.
The PEVVELA developer does not receive full payment credentials and cannot independently cancel a transaction processed by Apple unless App Store mechanisms allow it.
Nothing in these Terms limits mandatory consumer rights that cannot be excluded by contract.
14. Free access, trials, and changes to paid features
PEVVELA may offer free features, limited free capabilities, trial periods, or temporary access to PEVVELA Plus features.
Terms of such offers may vary by version, region, or period. If separate terms exist for a specific offer, they are shown before activation.
We may change future PEVVELA Plus feature composition. Changes do not cancel mandatory rights regarding an already paid period and do not change the current subscription price except as permitted by App Store rules and applicable law.
15. Prohibited use
You agree not to use PEVVELA to:
- infringe copyright or other third-party rights;
- unlawfully distribute protected content;
- circumvent DRM, Apple Music, App Store, or other service restrictions;
- attempt unauthorized access to others’ devices;
- intentionally disrupt Speaker Group or local network operation;
- distribute malicious code;
- reverse engineer or bypass technical limits except where permitted by law;
- use the app for unlawful purposes.
16. Diagnostics and support
PEVVELA may let you voluntarily export a diagnostics package and attach it to a support request.
You decide whether to send diagnostics. Before sending, consider that the file may contain technical information about your device and Speaker Group as described in the Privacy Policy.
We may use received diagnostics to investigate errors, respond to requests, improve stability, and protect the service from abuse.
17. App updates
We may release PEVVELA updates to add features, fix bugs, improve security, maintain iOS compatibility, or meet Apple and legal requirements.
Some features may stop working correctly on older app or OS versions. In reasonable cases, continuing to use certain features may require updating PEVVELA or iOS.
18. Changes or discontinuation of features
We may change, suspend, or discontinue individual free features when necessary for technical, product, legal, or security reasons.
We will consider applicable consumer law and obligations regarding paid services already purchased. If a change materially affects a paid service in force, user rights under law and App Store rules apply.
19. Intellectual property
PEVVELA, its software, interface, original graphics, design, text, logos, and other developer materials are protected by applicable intellectual-property law.
Apple, Apple Music, App Store, iOS, AirPlay, and other Apple names and materials belong to Apple Inc. or respective owners. Use of such names in PEVVELA does not transfer rights in them to you.
Music, artwork, and other third-party materials remain the property of their respective owners.
20. Third-party services
PEVVELA may interact with Apple services and, at your choice, other apps or services through iOS system features.
We are not responsible for content, availability, rules, pricing, security, or operation of independent third-party services. Your relationship with such services is also governed by their own terms.
21. Disclaimer of warranties
To the maximum extent permitted by law, PEVVELA is provided “as is” and “as available.”
We aim to provide quality and stable operation but do not guarantee that the app will always operate without errors, interruptions, or incompatibility, that Speaker Group will always discover a particular device, or that synchronization will be mathematically identical on all hardware and network conditions.
This section does not exclude warranties and rights that cannot be limited under applicable consumer law.
22. Limitation of liability
To the maximum extent permitted by law, the developer is not liable for indirect, incidental, special, or consequential damages arising from use or inability to use PEVVELA where such liability may be lawfully limited.
You are responsible for backing up important files. Export, deletion, modification by third-party apps, device failure, or app removal may result in loss of local data.
Nothing in these Terms limits liability where such limitation is prohibited by law, including mandatory consumer rights.
23. Termination
You may stop using PEVVELA at any time by deleting the app. An active subscription must be cancelled separately through Apple if you do not want it to renew.
We may restrict use of certain features in case of material breach of these Terms where technically applicable and permitted by law.
24. Privacy
Processing of data when using PEVVELA is described in the PEVVELA Privacy Policy, available in the app and at ../privacy/.
25. Apple Standard EULA
If the app is distributed through the Apple App Store and no separate custom EULA applies, the license to the app is also governed by Apple’s Standard EULA:
https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These Terms supplement applicable Apple terms. If a provision of these Terms conflicts with mandatory Apple terms or applicable law, the mandatory rule prevails to the extent of the conflict.
26. Governing law
These Terms are governed by the laws of Republic of Estonia, excluding conflict-of-law rules, while mandatory consumer rights in your country of residence remain in force where applicable.
For consumers in the European Union, these Terms do not remove protection provided by mandatory rules of your country of residence.
27. Changes to these Terms
We may update these Terms when PEVVELA features, commercial model, Apple requirements, or law change.
The current version is published at ../terms/ and available in the app. The document shows the last-updated date.
If a change materially affects a paid service or your rights, we will provide notice and other measures to the extent required by law or App Store rules.
28. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.
29. Entire agreement
These Terms, the Privacy Policy, the applicable Apple EULA, and mandatory App Store rules form the main terms governing use of PEVVELA in the relevant part.
